Senate Approves Mustello Bill to Assist Business Owners with Transfer Liquor Licenses

The Pennsylvania state Senate has passed legislation that will assist business owners in transferring liquor licenses. The bill, sponsored by Representative Marci Mustello, allows for the transfer of liquor licenses that have received pre-approval, as long as a surcharge is paid.

Under House Bill 38, liquor licenses for hotels, restaurants, clubs, distributors, importing distributors, and retail distributors can be transferred if the licensee is unable to meet the requirements for operating authority. However, this can only be done if the transfer request is accompanied by a surcharge. The amount of the surcharge will vary depending on the county where the license is located. It will be $15,000 for licenses in counties of the first through third class, and $5,000 for licenses in counties of the fourth through eighth class.

The legislation also includes a provision that designates the time between the approval of an initial application and the issuance of operating authority as time in safekeeping. This provision aims to address complications in the process of transferring specific classifications of liquor licenses.

Representative Mustello, the sponsor of the bill, expressed her support for the legislation, stating, "It maintains Pennsylvania's high standards for the operation of establishments, while removing barriers and reducing time to getting new businesses up and running." She also highlighted that the bill will be beneficial for business owners who need to transfer liquor licenses in certain circumstances.

House Bill 38 has now been sent to the governor's desk for his signature. If signed into law, this legislation will provide business owners with more flexibility and streamline the process of transferring liquor licenses in Pennsylvania.
